Act of the National Aviation Museum of Korea

Act of the National Aviation Museum of Korea [Enforced on November 21, 2019] [Act No. 16490, enacted on August 20, 2019] Article 1 (Purpose); This Act serves as a blueprint for the promotion and development of aviation culture and industry through the establishment of the National Aviation Museum of Korea. The National Aviation Museum aims to discover, conserve, research, and exhibit aviation culture and the aviation industry.
Article 2 (Legal person): The National Aviation Museum (hereinafter referred to as “the Museum”) shall be based on a legal person.
Article 3 (Establishment): ① The Museum shall be established in the main location of office through registration of incorporation. ② Registration of incorporation in accordance with Clause 1 shall include the following Subparagraphs. 1. Purpose; 2. Name; 3. Main office and affiliated institution; 4. Names and addresses of executives; 5. Method of announcement ③ Regarding registration of incorporation of the Museum, matters beyond those stipulated in this Act shall apply regulations concerning Incorporated foundations included in the “Civil Law.”
Article 4 (Articles of Association): ① The Articles of Association shall include the following Subparagraphs. 1. Purpose; 2. Name; 3. A place to determine the main office; 5. Matters regarding duties and the relevant execution; 6. Matters regarding assets and accounting; 7. Matters regarding organizations and affiliated institutions; 7. Matters regarding executives 8. Matters regarding Board of Directors; 9. Matters regarding the modification of Articles of Association; 10. Matters regarding the method of announcement ② To modify Articles of Association of the Museum, more than two-thirds of the directors registered in the Board of Directors, and the Minister of Land, Infrastructure and Transport ought to approve it.
Article 5 (Businesses / projects): ① The Museum shall carry out the following businesses (projects) Subparagraphs. 1. Establishment and implementation of basic operation plans and medium and long-term plans for the Museum; 2. Collection, conservation, management and exhibition of museum’s materials (all “materials” mentioned throughout this text refer to museum materials related to aviation culture and industry prescribed by the Presidential Decree); 3. Investigation and research of the Museum’s materials; 4. Education regarding the Museum’s materials; 5. Promotion of the Museum’s materials and production and distribution of various publication related to them; 6. Operation and management of the affiliated institutions; 7. Domestic and overseas exchange and cooperation in themes related to the Museum’s materials; 8. Profitable businesses to raise operational finance within the scope of the Museum’s purpose and vision; 9. Duties belonging to Subparagraph’s 1 to 8; 10. Duties related to aviation consigned by the Minister of Land, Infrastructure and Transport ② To carry out profitable businesses pursuant to Subparagraph 8 of Clause 1, it is required that each business should be approved by the Minister of Land, Infrastructure and Transport.
Article 6 (Executives): ① The executives of the Museum shall consist of one Director of the Museum, two executive directors, at most six non-executive directors and one auditor. ② The auditor shall be a non-executive member. ③ The Director of the Museum shall be appointed and dismissed by the Minister of Land, Infrastructure and Transport according to Articles of Association, while executive directors, non-executive directors and auditor shall be appointed and dismissed pursuant to stipulation of Articles of Association.
Article 7 (Term of executives): ① The term of executives shall be three years, and they may serve consecutive terms by unit of one year. ② When an executive member is appointed due to the resignation of another member, the newly appointed member commences a new term of three years.
Article 8 (Duties of executives): ① The Director of the Museum, as a representative of the Museum, shall be in charge of general management of duties, as well as the direction and supervision employees of the Museum. ② In case the Director of the Museum is not able to conduct the assigned duties due to extenuating circumstances, the executive director according to the order stipulated in Articles of Association shall deputize as stipulated; In case the executive director is not able to carry out the duties either, an executive according to stipulation of Articles of Association shall be an acting Director of the Museum. ③ The members of the Board of Directors (directors) shall attend the Board of Directors meeting and deliberate the matters submitted to the Board of Directors meeting. ④ The auditor shall audit the accounting of the Museum and the execution of duties.
Article 9 (Grounds for disqualification of executives): ① Those who do not comply with any of the following Subparagraphs shall not be qualified to act as an executive of the Museum. 1. A person who does not comply with any of Subparagraphs of Article 33 of State Public Official Act; 2. A person whose period has not passed three years from the dismissal date, according to Clause 1 of Article 22, Clauses 2 & 3 of Article 35, Clause 2 of Article 36 or Clause 4 & 8 of Article 48 under the Act on the Management of Public Institutions. ② If the executive turns out to be or have been one of the Subparagraphs of Clause 1, he / she is justifiably expected to resign. ③ The act which the resigning executive, according to Clause 2, was involved in before the resignation shall not lose effect.
Article 10 (Board of Directors): ① The Museum shall have the Board of Directors to decide and deliberate important matters of the Museum. ② The Board of Directors shall consist of directors including the Chairperson. ③ The Chairperson of the Board of Directors shall be the Director of the Museum. In case the Chairperson of the Board of Directors is not able to take on the role due to extenuating circumstances, the executive director according to the order stipulated in Articles of Association shall deputize. In case the executive director is not able to play the role either, a person voted on by the non-executive directors shall deputize. ④ When the Chairperson deems necessary, he / she can convene a Board of Directors meeting. Nonetheless, it is mandatory to convene Board of Directors meetings in case more than one-third of registered directors request it, or in case the auditor requests to present the audit results on any illegal or unlawful matters. ⑤ The Board of Directors shall approve with the majority of registered directors. ⑥ The auditor can state his/her opinion by attending the Board of Directors meeting in case he / she finds it necessary for the relevant duty.
Article 11 (Financial resources): ① The expenses required for businesses and operation of the Museum shall be supplied by the following Subparagraphs. 1. Contributions or donations from the State or a person (entity) other than the State; 2. Loan in accordance with Article 13; Income produced by the operation of the Museum; 4. Additional revenue ② The State can contribute expenditure required for businesses and operation of the Museum within the budget. ③ An individual / legal person (corporation) or an institution can contribute or donate money or other assets to the Museum, in order to support the execution of duties of the Museum. ④ Specific matters concerning the reception process of contributions and donations related to Clause 3 shall be defined by the Presidential Decree.
Article 12 (Business year and business plan): ① The business year of the Museum shall mirror the fiscal year of the government. ② According to the Presidential Decree, the Director of the Museum shall draw up and submit the business plan and budget bill before the start of every business year and receive approval from the Minister of Land, Infrastructure and Transport. The same applies when intending to modify them. ③ According to the Presidential Decree, the Director of the Museum shall inform the Minister of Land, Infrastructure and Transport of business performance for every fiscal year and provide a statement of revenue and expense. The latter is decided on by the Board of Directors after seeing the results of the accounting audit conducted by a certified public accountant (including an accounting firm according to the Article 23 under the Certified Public Accountant Act), within two months after the completion of every fiscal year.
Article 13 (Loan): In case it is necessary for operation, the Museum can borrow funds by getting approval from the Minister of Land, Infrastructure and Transport.
Article 14 (Supporter’s Association): ① The Museum can have a Supporter’s Association composed of members supporting funds necessary for smooth operation. ② The Supporter’s Association may receive donation from the members or collect goods necessary for the Museum. ③ The Supporter’s Association shall hand over the donation or collected goods received according to Clause 2 to the Museum, pursuant to the stipulation by the Minister of Land, Infrastructure and Transport. ④ All matters required for the organization and operation of the Supporter’s Association shall be defined by the Presidential Decree.
Article 15 (Consignment and management of the Museum’s materials): ① The State can consign management of the State-owned museum materials, which were under the management of the Minister of Land, Infrastructure and Transport at the moment of establishment of the Museum, for professional conservation and research, despite the regulations stipulated in the Commodity Management Act. ② The employees in charge of managing the Museum’s materials possessed by the Museum or under the management consignment of the State according to Clause 1 ought to not only comply with the laws and relevant regulations on the management of the museum materials but also perform duties with special attention as good managers.
Article 16 (Request for provision of materials): The Director of the Museum can request for display, copy, rental or consigned exhibition of the materials related to aviation culture or aviation industry upon the request of the relevant administrative institutions, educational institutions, research agencies or other people concerned.
Article 17 (Request for dispatch of public officials): ① The Director of the Museum shall have rights to request dispatch of public officials to the head of the relevant administrative institution or educational institution by obtaining approval of the Minister of Land, Infrastructure and Transport, when the assistance of the public officials is particularly needed to perform specific duties. ② According to Clause 1, the head of the relevant administrative institution or educational institution can dispatch the public officials belonging to their institution to the Museum.
Article 18 (Supervision): ① When deemed necessary to instruct and supervise the Museum, the Minister of Land, Infrastructure and Transport can give recommendation or command regarding the concerning duty of the Museum. ② The Minister of Land, Infrastructure and Transport shall evaluate operation of the Museum, according to standards and processes defined by the Presidential Decree and prepare necessary measures depending on the evaluation results. ③ When the Minister of Land, Infrastructure and Transport recognizes the necessity, the Minister can order the Museum to report on matters of relevant duties, accounting and assets of the Museum or inspect the concerned matters.
Article 19 (Preservation of the surrounding landscape): The head of local government shall take proper measures to preserve the surrounding landscape when giving construction permit pursuant to Article 11 of the Architecture Act to the neighboring areas of the Museum within the scope defined by ordinance.
Article 20 (Obligation of keeping confidentiality): An employee or a person who has served as an employee of the Museum shall not divulge any confidential information learned during his/her duties or use the information to obtain profits of wealth or property.
Article 21 (Prohibition of use of similar names): No one other than the National Aviation Museum of Korea pursuant to this Act shall use name “the National Aviation Museum of Korea” or a similar name.
Article 22 (Applicability): For matters not stipulated in this Act regarding the Museum, the provisions of the Civil Law concerning an incorporated foundation shall apply.
Article 23 (Public Officials' agenda in application of penal provisions): Employees of the Museum shall be deemed public officials when the provisions of Articles 129 through 132 of the Criminal Act apply.
Article 24 (Penalty): Anyone who divulges confidential information learned during his/her duties or obtains profits of wealth or property using the information will be in violation of Article 20 and shall be punished by imprisonment for no more than two years or a be charged a fine not exceeding 20 million won.
Article 25 (Fines for negligence): ① Fines not exceeding 5 million won shall be imposed on a person who uses the name “The National Aviation Museum of Korea” or a similar name in violation of Article 21. ② Fines for negligence under Clause 1 shall be imposed and collected by the Minister of Land, Infrastructure and Transport as prescribed by the Presidential Decree.
Supplementary provisions
Article 1 (Enforcement date): This Act shall enter into force after three months have passed since its promulgation. On the other hand, Articles 2 and 7 of the Supplementary Provisions shall be enforced from the date of promulgation.
Article 2 (Preparation for establishment): ① The Minister of Land, Infrastructure and Transport shall set up an Establishment Committee of the National Aviation Museum of Korea (hereinafter referred to as the "Establishment Committee") consisting of no more than 5 founding members within two months of the date of promulgation of this Act, to allow the Committee to be in charge of office work for the establishment of the Museum as well as the appointment of directors and auditors at the time of establishment. In this case, the Minister of Land, Infrastructure and Transport shall appoint or commission the Chairperson and Committee members. ② The Establishment Committee shall prepare the Articles of Association of the Museum and obtain approval from the Minister of Land, Infrastructure and Transport. ③ The Minister of Land, Infrastructure and Transport shall appoint the Director of the Museum at the time of establishment. ④ When the Establishment Committee obtains approval pursuant to Clause 2, it must immediately make the registration of the establishment of the Museum in a joint signature and hand over the affairs to the Director of the Museum.⑤ When the transfer of affairs pursuant to Clause 4 is completed, the Establishment Committee is deemed to have been dissolved, and the founding members are deemed to have been dismissed. ⑥ The Minister of Land, Infrastructure and Transport shall pay the expenses incurred for the establishment of the Museum, until it is established. ⑦ The Minister of Land, Infrastructure and Transport may request the dispatch of executives and employees of relevant institutions and organizations, if necessary for duties for the establishment of the Museum. [Enforcement date: August 20, 2019].
Article 3 (Free Transfer of commodity): Despite the regulations stipulated in the Commodity Management Act, the State-owned goods (excluding the Museum materials) managed by the Ministry of Land, Infrastructure and Transport (limited to the operation of the National Aviation Museum of Korea) at the time this Act entered into force, it can be transferred to the Museum for free of charge. In this case, the Minister of Land, Infrastructure and Transport shall hear the opinion of the Director of the Museum whether the relevant goods are necessary, and consult with the Minister of Economy and Finance beforehand.
Article 4 (Succession of rights and obligations): The Museum established pursuant to this Act shall comprehensively inherit rights and duties belonging to the Ministry of Land, Infrastructure and Transport (limited to the operation of the National Aviation Museum of Korea) at the time of enforcement of this Act.
Article 5 (Budget at the time of establishment): ① The Museum established pursuant to this Act can execute the existing budget under the Ministry of Land, Infrastructure and Transport (limited to the operation of the National Aviation Museum of Korea) in accordance with the previous example until the budget of the Museum at the time of establishment is confirmed. ② Once the Museum's budget is established, expenses executed pursuant to Clause 1 are deemed to have been executed in accordance with the established budget.
Article 6 (Special cases for appointment of employees): ① The Minister of Land, Infrastructure and Transport ought to distinguish public officials who were engaged in the affairs related to the establishment of the Museum at the time of enforcement of this Act, between those who will be appointed as employees of the Museum, according to the employees’ wish, and those who will not be appointed as employees of the Museum. ② A person who wishes to be appointed as an employee of the Museum pursuant to Clause 1 shall be deemed to have retired from a public official position at the time of establishment of the corporation (the Museum) and will be appointed as an employee of the Museum. ③ Matters regarding the affiliated institutions, guarantee of status and service duties of public officials who do not wish to be appointed as employees of the Museum pursuant to Clause 1 shall be prescribed by the Presidential Decree. ④ The retirement age of a person who retires from a public official position and is appointed as an employee of the Museum pursuant to Clause 2 shall mirror the retirement age under the State Public Official Act, corresponding to the position at the time of retirement of the employee. In case the retirement age employees of the Museum is longer than the retirement age prescribed in the State Public Official Act, the retirement age of employees of the Museum shall apply.
Article 7 (Transitional measures concerning budget formulation): The Establishment Committee of the Museum may prepare a budget for the first business year of the Museum after its establishment. [Enforcement date: August 20, 2019].

Enforcement of Act on the National Aviation Museum of Korea

Enforcement of Act on the National Aviation Museum of Korea [Enforcement November 21, 2019] [Presidential Decree No. 30211, enacted on November 19, 2019] Article 1 (Purpose): The purpose of this Decree is to stipulate matters consigned by the Act on National Aviation Museum of Korea as well as matters necessary for its enforcement.
Article 2 (Museum materials): “What is prescribed by the Presidential Decree” in Subparagraph 2, Clause 1 of Article 5 under the Act on National Aviation Museum of Korea (hereinafter referred to as the “Act”) refers to tangible and intangible materials that meet all of the following requirements: In this case, the scope of intangible materials shall be limited to materials that can be expressed in codes, letters, sound, audio and video. 1. To accomplish the purpose of establishment and carry out projects of the National Aviation Museum of Korea (hereinafter referred to as the “Museum") pursuant to Article; 2 of the Act, the intangible materials ought to have academic and artistic value enough to be collected, preserved, managed, investigated, researched, and exhibited in the Museum; 2. The intangible materials ought to encompass history, folklore, art, science, technology and industry related to aviation culture and aviation industry;
Article 3 (Profitable Businesses): ① Profitable businesses pursuant to Subparagraph 8, Clause 1 of Article 5 of the Act shall comprise the following Subparagraphs: 1. Admission to the Museum and visits to exhibition rooms; 2. Lease of Museum facilities; 3. Production and sale of museum-related souvenirs, publications and booklets; 4. Distribution of educational programs developed by the Museum; 5. Advertisements using museum facilities; 6. Installation and operation of aviation-related experience facilities; 7. Other businesses deemed necessary by the Minister of Land, Infrastructure and Transport to raise revenues for the operation of the Museum; ② When the Museum intends to obtain approval for profitable businesses pursuant to Clause 2 of Article 5 under the Act, it shall be required to submit the documents of the following Subparagraphs to the Minister of Land, Infrastructure and Transport following the approval from the Board of Directors pursuant to Article 10 of the Act (hereinafter referred to as "the Board of Directors"). 1. Approval application for profitable business; 2. Profitable business plan; 3. Estimated profit and loss statement and its annexed detailed statement; ③ In case the Museum intends to conduct an approved profitable business, it is required to report the business plan for the next business year to the Minister of Land, Infrastructure and Transport by October 1 of the previous year. It is not necessary to report it if a profit business plan is submitted to obtain approval for a profitable business pursuant to Clause 2 of the year in concern. ④ The Museum must submit the performance results and balance sheet of the profitable business to the Minister of Land, Infrastructure and Transport by March 31 of the business year following the business year in question. ⑤ The Museum must establish and manage separate accounts for income and expenses incurred from operation of profitable businesses.
Article 4 (Submission of budget request form of contributions): ① When the Museum intends to request contributions from the State pursuant to Clause 2 of Article 11 under the Act, it shall attach the documents indicated in the following Subparagraphs to the budget request form of contributions, and submit them to the Minister of Land, Infrastructure and Transport, by April 30 every year 1. A business plan for the next business year; 2. A statement of estimated financial state and an estimated profit and loss statement, and the annexed detailed statements for the next business year; 3. Other materials that can explain the request for contributions; ② In case the Minister of Land, Infrastructure and Transport deems that the budget request pursuant to Clause 1 is reasonable, the Minister shall formulate budget proposal reflecting the details and notify the fact to the Museum when the budget for contributions is confirmed.
Article 5 (Payment of contributions): ① When the Museum intends to receive contributions pursuant to Clause 2 of Article 11 under the Act, the following Subparagraph documents shall be submitted to the Minister of Land, Infrastructure and Transport. 1. Application form of contribution payment; 2. Quarterly business plan; 3. Quarterly budget execution plan; ② If the descriptions of the quarterly business plan and quarterly budget execution plan submitted pursuant to Clause 1 are deemed appropriate, the Minister of Land, Infrastructure and Transport shall pay contributions duly. ③ The Museum must establish and manage a separate account for the contributions paid pursuant to Clause 2, and use it only for the purposes defined in the quarterly business plan and quarterly budget execution plan pursuant to Clause 1. ④ In case the Museum has received contributions pursuant to Clause 2, it must notify the Minister of Land, Infrastructure and Transport of the quarterly execution results within 20 days before the end of the corresponding quarter.
Article 6 (Procedures for reception of donations) ① In case the Museum receives money or other property donations from individuals, corporations, or institutions pursuant to Clause 3 of Article 11 under this Act, the Museum shall issue a receipt to the donor. If anonymous donations have been received or if the donor is unknown, a receipt may not be issued. ② When the donor designates the use of money or other property donated pursuant to Clause 1 (hereinafter referred to as "donations”), the donation shall be used only for that designated purpose. However, if there is a special reason for the difficulty of using the donation for the purpose designated by the donor, it may be used for other purposes with the consent of the donor. ③ The Museum shall have a ledger displaying the status of reception and use results of donations to allow donors to access the information. ④ The Museum shall manage donations by establishing a separate account.
Article 7 (Submission of business plan); ① When the Director of the Museum (hereinafter referred to as the "Director") intends to receive approval of the business plan and budget according to Clause 2 of Article 12 of the Act, the Director must submit the relevant documents for the next business year to the Minister of Land, Infrastructure and Transport, by December 15 every year. ② The business plan pursuant to Clause 1 shall include the following Subparagraph matters for each business. 1. Business objectives; 2. Business details; 3. Beneficiary targets; 4. Business expenses; 5. Other items necessary to clarify the details of the business plan; ③ The budget bill pursuant to Clause 1 shall include the following matters from each Subparagraph. 1. General provisions of budget; 2. A statement of estimated financial state, an estimated profit and loss statement, and the annexed detailed statements; 3. Funding plan; 4. Other matters necessary to clarify the details of the budget; ④ When the Director intends to change the approved business plan and budget bill, the Director shall submit following to the Minister of Land, Infrastructure and Transport: 1. Documents stating the changed contents and reasons; 2. Business plan and budget bill reflecting the changed contents;
Article 8 (Submission of balance sheet): According to Clause 3 of Article 12 of the Act, the Director shall submit the following documents of each Subparagraph to the Minister of Land, Infrastructure and Transport attaching the business performance report and balance sheet of income and expenditure for each fiscal year. 1. Financial statements for the relevant fiscal year (including the opinion of a certified public accountant or the opinion of an auditor of an accounting firm pursuant to Article 23 of the Certified Public Accountant Act) as well as the annexed documents; 2. A business plan for the relevant fiscal year and the comparison table of its execution results; 3 A copy of the Minutes of the Board of Directors meeting regarding the resolution of the balance sheet of income and expenditure; 4. Other documents necessary to clarify the details of the settlement;
Article 9 (Application for approval of loan): If the Museum intends to obtain approval for the borrowing of funds pursuant to Article 13 of the Act, the Museum shall submit an application form for approval of loans to the Minister of Land, Infrastructure and Transport attaching the following documents indicated in each Subparagraph: 1. Documents clarifying the borrowing place, reason for loan, terms and amount of loan; 2. Documents stating the repayment method and repayment period of the loan; 3. Other documents stating necessary matters for loan and repaying the loan;
Article 10 (Handling of surplus): The Museum shall first allocate the surplus of each business year for debt repayment, and carry the remaining surplus forward to the next business year or use for business execution of the Museum.
Article 11 (Organization and operation of Supporter’s Association) ① The Supporter’s Association of the Museum (hereinafter referred to as “Supporter’s Association") pursuant to Clause 1 of Article 14 of the Act shall comprise individuals or corporations intending to support the businesses (projects) of the Museum. ② Members of the Supporter’s Association can provide money or other academic materials for the Museum through the Supporter’s Association. In this case, members of the Supporter’s Association may designate and apply for a specific business (project) among the businesses (projects) of the Museum. ③ The Director may distribute the publications published in the Museum to members of the Supporter’s Association free of charge or consider exemptions of admission, exhibition fees, or facility usage fees. ④ When the Museum is provided with money or academic materials from the Supporter’s Association according to Clause 2, the Director must notify the Supporters’ Association regarding the details of usage by December 31 of each year.
Article 12 (Consignment and management of Museum’s materials): ① In the event of damage or harm to Museum’s materials consigned by the state according to Clause 1 of Article 15 of the Act, it is the Director’s obligation to inform the Minister of Land, Infrastructure and Transport without delay. ② According to Clause 1 of Article 15 under this Act, the Director must obtain approval from the Minister of Land, Infrastructure and Transport in advance to perform large-scale repairs or maintenance where the original form of Museum’s materials consigned by the state is changed. However, in case of an emergency, it is possible to take necessary minimum measures and notify the fact to the Minister of Land, Infrastructure and Transport without delay. ③ According to Clause 1 of Article 15 of the Act, when the management of museum materials are consigned, the Minister of Land, Infrastructure and Transport may support expenses necessary for conservation, processing and management within the scope of the budget.
Article 13 (Request for dispatch of public officials): ① When the Director intends to receive approval from the Minister of Land, Infrastructure and Transport, to request dispatch of public officials to the head of the relevant administrative institution or educational institution, the Director shall submit the following matters of each Subparagraph in the request for approval to the Minister. 1. Reasons for dispatch request; 2. Dispatch period; 3. Dispatched personnel; 4. Specialized field of dispatched personnel and qualification requirements; ② Public officials dispatched to the Museum according to Clause 2 of Article 17 of the Act shall comply with the service regulations defined by the Director, during the dispatch period. ③ The Museum may pay allowances to public officials dispatched pursuant to Article 17 of the Act in accordance with the standards prescribed by the Articles of Association of the Museum. Nevertheless, allowances paid to dispatched public officials shall not exceed the standards for each of the following Subparagraphs: 1. For state public officials: Standards determined by the Director General of Personnel Innovation Bureau pursuant to Clause 8 of Article 41 under “Appointment Decree of Public Officials; 2. For local public officials: Standards determined by the Ministry of the Interior and Safety, according to Clause 6 of Article 27-2 under “Appointment Decree of Public Officials;
Article 14 (Implementation of operation evaluation): ① The Minister of Land, Infrastructure and Transport shall conduct an operation evaluation every three years according to Clause 2 of Article 18 of the Act (hereinafter referred to as “operation evaluation”). ② Standards of operation evaluation shall comply with the following Subparagraphs. 1. Evaluation of the management status of the Museum: Degree of responsible management and work efficiency, and the appropriateness of budget, organization, and human resource management; 2. Evaluation of the project performance such as collection, conservation, management and exhibition of Museum’s materials; Degree of expansion of the collection base of the Museum’s materials, and operation results of the basic operation plan and mid- to long-term development plan of the Museum; 3. Evaluation of public services related to the operation of the Museum: Level of customer satisfaction and public perception, and service improvement performance; ③ In order to conduct an operation evaluation, the Minister of Land, Infrastructure and Transport must prepare an evaluation guideline that clearly specifies the basic direction, standards, targets, and schedule of the operation evaluation, and notify the Museum 3 months before the implementation date of the operation evaluation.
Article 15 (Standards for imposition of fines): The standards for imposition of fines pursuant to Clause 1 of Article 25 of the Act are described in the following attached table. [Enforcement November 21, 2019] [Presidential Decree No. 30211, enacted on November 19, 2019] This Decree will take effect from November 21, 2019.

Articles of Association of the National Aviation Museum of Korea Chapter 1: General Provisions Article 1 (Purpose): This corporation aims to contribute to developing aviation culture, art, science, technology, and industry through research, management, conservation, investigation, research, education and exhibition of heritage of history, folklore, art, science, technology and industry related to aviation according to the Act on the National Aviation Museum Act (hereinafter referred to as the "Act").
Article 2 (Name): ① This corporation is referred to as the National Aviation Museum of Korea (hereinafter referred to as the "Museum"). ② The English name of the Museum is indicated as National Aviation Museum of Korea ("NAMOK" for abbreviation).
Article 3 (Location): The main office of the Museum shall be located in Seoul, and affiliated institutions may be established if necessary.
Article 4 (Businesses/ Projects): ① The Museum shall perform the following businesses indicated in the Subparagraphs to achieve the purpose of Article 1. 1. Collection, conservation, management and exhibition of museum’s materials (all “materials” mentioned throughout this text refer to museum materials related to aviation culture and industry prescribed by the Presidential Decree); 2. Research of museum’s materials, publication of related books and magazines, and holding related symposiums; 3. Development, operation and distribution of the museum materials and educational programs regarding aviation-related history, humanity, folklore, art, science, technology, and industry; 4. Promotion of the Museum’s materials, production / distribution of various publications and performances; 5. Operation and management of affiliated institutions; 6. Domestic and foreign exchanges and cooperation related to the museum materials; 7. Profitable businesses to finance the operation within the scope of the purpose of the establishment of the Museum; 8. Nurturing professional work force for collection, management, conservation, investigation, research, exhibition, and education of the museum materials; 9. Duties accompanying the businesses from Subparagraph 1 through 8; 10. Other aviation-related duties consigned by the Minister of Land, Infrastructure and Transport; ② In order to conduct a profitable business indicated in the Subparagraph 7 of Clause 1, each business shall be required to obtain approval from the Minister of Land, Infrastructure and Transport.
Chapter 2 Executive and Employees
Article 5 (Executives): The Museum shall have the following executives. 1. One Director of the Museum; 2. Two executive directors; 3. At most six non-executive directors (including ex officio members); 4. One non-executive auditor;
Article 6 (Appointment of executives): ① The Director shall be appointed by the Minister of Land, Infrastructure and Transport among the multiple candidates recommended by the Executive Recommendation Committee. ② Executive directors are appointed by the Director among the multiple candidates recommended by the Executive Recommendation Committee. ③ Non-executive directors are appointed by the Minister of Land, Infrastructure and Transport among the multiple candidates recommended by the Executive Recommendation Committee. In addition, Director General for Policy (Head of Direction) in charge of the Museum within the Ministry of Land, Infrastructure and Transport shall be an ex officio non-executive director. ④ The auditor shall be appointed by the Minister of Land, Infrastructure and Transport among the multiple candidates recommended by the Executive Recommendation Committee. ⑤ In the case of executives who are reappointed according to Clauses 1 and 2 of Article 2, shall not require recommendation of the Executive Recommendation Committee.
Article 7 (Term of office of executives) ① The term of executives shall be three years, and they may serve consecutive terms by unit of one year. In this case, the authority to appoint an executive shall decide whether or not to reappoint an executive, considering his / her job performance. ② When an executive member is appointed due to the resignation of another member, the newly appointed member commences a new term of three years. ③ Executives whose term of office has expired shall perform their duties until their successors are appointed.
Article 8 (Executive Recommendation Committee): ① The Museum shall compose and operate an Executive Recommendation Committee. ② Matters necessary for the composition and operation of the Executive Recommendation Committee shall be determined by the “Operation Regulations of Executive Recommendation Committee.”
Article 9 (Duties of executives): ① The Director of the Museum, as a representative of the Museum, shall be in charge of general management of duties, as well as the direction and supervision employees of the Museum. ② The Director shall convene the Board of Directors and become its Chairperson. In case the Director position is vacant, the executive director shall convene the Board of Directors and become the Chairperson according to the order determined by the Organization Regulations. ③ The executive director shall assist the Director and supervise and coordinates the affairs. In case the Director is not able to take on the role due to extenuating circumstances, the executive director shall deputize. ④ The members of the Board of Directors (directors) shall attend the Board of Directors meeting and deliberate and decide the matters submitted to the Board of Directors meeting.⑤ The auditor shall audit the accounting of the Museum and the execution of duties.
Article 10 (Responsibilities of directors and auditors): Regarding the responsibilities of directors and auditors, Article 35 of the Act on the Management of Public Institutions shall apply.
Article 11 (Grounds for disqualification of executives): ① Those who do not comply with any of the following Subparagraphs shall not be qualified to act as an executive of the Museum. 1. A person who does not comply with any of Subparagraphs of Article 33 of State Public Official Act; 2. A person whose period has not passed three years from the dismissal date, according to Clause 1 of Article 22, Clause 2 & 3 of Article 35 or Clause 4 & 8 of Article 48 under the Act on the Management of Public Institutions. ② If the executive turns out to be or have been one of the Subparagraphs of Clause 1, he / she is justifiably expected to resign. ③ The act which the resigning executive, according to Clause 2, was involved in before the resignation shall not lose effect.
Article 12 (Dismissal of executives): A person with an authority to appoint and dismiss executives may dismiss an executive if the executive falls under any of the following Subparagraphs: 1. In case the executive violated laws or orders or Articles of Association; 2. In case the executive caused impediment in operation of the Museum due to accounting fraud, intentional or serious negligence; 4. In case the executive has serious difficulty performing the duties or is unable to perform them due to mental and physical disorders; 4. In case the executive falls under under any of the Subparagraphs of Clause 1 of Article 11; 5. In cases the person with authority to appoint dismisses the executive according to Clause 1 of Article 22, Clause 6 of Article 31, Clause 3 of Article 35 and Clause 2 of Article 36 under the Act on the Management of Public Institutions.
Article 13 (Appointment and dismissal of employees): ① The Director of the Museum shall appoint and dismiss employees as prescribed in the “Personnel Regulations.” ② When hiring employees, the Director shall hire, in principle, based on an open competition test. ③ Notwithstanding the provisions of Clause 2, the Director, if necessary, may hire employees through the limited competition test method oriented at multiple people with the same conditions, with consideration for position and job characteristics. ④ If the Director deemed it necessary, the Director may hire employees through special screening. In this case, the Director shall hire a person meeting the recruitment qualification criteria determined in the “Personnel Regulations” after deliberation at the Personnel Committee.
Article 14 (Establishment of Personnel Committee): ① A Personnel Committee shall be established for fairness and rationality in recruiting and managing personnel. ② The Personnel Committee shall deliberate the basic policy of personnel management and overall personnel management. ③ The Personnel Committee shall be composed of the Museum's employees. However, if the Director deems it necessary, it is allowed to commission an external member. ④ When the Director hires new employees based on special screening, it shall be required to form a separate Personnel Committee including three or more external members. ⑤ Other matters necessary for the composition and operation of the Personnel Committee shall be determined by the “Personnel Regulations.”
Article 15 (Guarantee of status) ① Executives excluding ex officio directors shall not be dismissed during their term of office except any of the following cases of Subparagraphs. 1. When violating laws, Articles of Association, or a legitimate resolution of the Board of Directors; 2. When causing a serious loss to the Museum due to intentional or important negligence; 3. When the Board of Directors recognizes that the person is unable to perform his/her duties due to physical or other reasons; 4. When the case falls under Clause 6 of Article 31 under the Act on Management of Public Institutions; ② Employees of the Museum shall not receive unfavorable disposition against their will, unless they are sentenced to punishment, punished by disciplinary action, or other reasons defined in the Personnel Regulations.
Article 16 (Remuneration of executives and employees): ① Remuneration standards for executives and employees shall apply “Remuneration Regulations” through decision of the Board of Directors according to the guidelines on remuneration specified by the Minister of Economy and Finance, and it shall be possible to determine the payment of severance pay and other actual expenses by job performance in a separate manner. ② For non-executive directors and auditors, payment can be made within the budget for actual expenses for attending meetings as well as service allowances required for job performance such as agenda deliberation and audit reports. ③ Executives with interests (potential biases) or potential biases are not allowed to participate in the Board of Directors meeting that decides the remuneration standards for executives pursuant to Clause 1.
Article 17 (Services of executives and employees): Matters related to the services of executives and employees shall comply with the provisions of the “Personnel Regulations” and “Service Management Regulations.”
Article 18 (Restriction of concurrent employment of executives and employees): ① The Museum's executive directors and employees are not allowed to engage in profit-making business other than their duties. ② When the Director of the Museum has obtained permission from the Minister of Land, Infrastructure and Transport, and when the executive directors and employees of the Museum has obtained permission from the Director, they may perform additional duties for non-profit purposes.
Article 19 (Obligations of executives and employees): ① The executives and employees of the Museum must comply with laws, Articles of Association, and various regulations when carrying out their duties, and perform them in good faith. ② Employees of the Museum and those dispatched to the Museum according to Article 17 of the Act and those who have been in that position must not divulge or steal secrets or personal information learned during their duties.
Article 20 (Cooperation): The Director may cooperate with educational institutions, research institutions, exhibition institutions from home and abroad and local governments, to promote the functions of the Museum with efficiency.
Chapter 3. Board of Directors
Article 21 (Establishment and functions of the Board of Directors): ① The Museum shall establish a Board of Directors to deliberate and decide the following matters indicated in the Subparagraphs. 1. Management objectives, mid- to long-term operation and development plans; 2. Annual business plans, budgets, and settlements; 3. Profitable business plans and settlements; 4. Carrying forward budgets to the following month and use of reserves; 5. Acquisition, disposal and management of basic assets; 6. Borrowing loan and repayment plan; 7. Disposal of surplus; 8. Modification of Articles of Association; 9. Enactment or abolishment of major regulations such as organization, personnel, remuneration, services and accounting; 10. Establishment and abolition of affiliated institutions; 11. Remuneration of executives; 12. Appointment of members of Executive Recommendation Committee; 13. Matters regarding mid- to long-term workforce supply and demand plans; 14. Matters requiring the approval of the Board of Directors in laws, Articles of Association or regulations; 15. Matters that the Director deems necessary and requests for deliberation and approval from the Board of Directors; 16. Other matters that the Board of Directors deems necessary; ② The Director shall report the following matters indicated in the Subparagraphs to the Board of Directors. 1. Matters pointed out in the parliamentary inspection, accounting audit and audit in the Board of Audit and Inspection, and the relevant plans of measures and results; 2. Results of collective agreements and the concomitant estimates of required budgets (limited to necessary cases); 3. Other matters requiring the report of the Board of Directors to the Director;
Article 22 (Composition of the Board of Directors); ① The Board of Directors shall comprise directors including the Chairperson. ② The Chairperson of the Board of Directors shall be the Director of the Museum. In case the Chairperson of the Board of Directors is not able to take on the role due to extenuating circumstances, the executive director according to the order stipulated in Organization Regulations shall deputize. In case the executive director is not able to play the role either, a person voted on by the non-executive directors shall deputize.
Article 23 (Convocation of the Board of Directors meeting): ① The Chairman of the Board of Directors may convene the Board of Directors meeting if deemed necessary. However, if there is a request of more than a third of the registered directors, or if the auditor requests the meeting to report the audit results of an illegal or unfair matter, the Board of Directors meeting must be convened. ② When the Director intends to convene the Board of Directors meeting, the Director must notify the directors and auditors of the purpose of the meeting, the date and place of the meeting 7 days prior to the meeting. However, if the Director finds it urgent, the Board of Directors meeting can be convened after notifying the matters prescribed in this Clause by one day before the meeting.
Article 24 (Decision of the Board of Directors): ① The Board of Directors shall hold the meeting with the attendance of a majority of the registered directors and make a decision with the approval of the majority of the registered directors. ② The Director or directors who have special interests in the agenda of the Board of Directors cannot participate in the resolution of the agenda. In this case, directors who are not allowed to participate in the resolution shall not be included in the number of registered directors indicated in the Paragraph 1. ③ Among matters to be resolved by the Board of Directors, the agenda that does not require approval from the Minister of Land, Infrastructure and Transport and that the Director deems as minor or urgent may be resolved in writing. In this case, the written resolution shall be substituted by the Minutes of the Board of Directors. ④ Resolutions and Minutes by means of communication of the Board of Directors shall follow Clause 2 of Article 391 of “Commercial Law” (Resolution method of the Board of Directors) Clauses 1 & 2 of Article 391-3 (Minutes of the Board of Directors), respectively.
Article 25 (Opinion statements of auditors and people concerned): The auditor may attend the Board of Directors meeting to state their opinions, and when the Director deems that it is necessary, may have a person related to the proposed agenda appear at the Board of Directors meeting to state their opinions.
Article 26 (Secretary of the Board of Directors): A secretary shall be appointed to perform affairs of the Board of Directors, and the Director shall appoint the Secretary among the employees of the Museum.
Article 27 (Request for dismissal): ① When the Board of Directors determines that the Director has significant obstacle to conduct assigned duties as a Director by committing acts violating the laws or Articles of Association and neglecting his duties, the Board of Directors can request dismissal of the Director to the Minister of Land, Infrastructure and Transport after obtaining approval from the Board of Directors. ② Non-executive directors may request, when deemed necessary, an audit on matters related to the operation of the institution or specific matters in a joint signature. In this case, the auditor ought to respond to this request unless there are special circumstances. ③ Non-executive directors may request data necessary for the performance of their duties from the Director. In this case, the Director ought to respond to this request unless there are special circumstances.
Article 28 (Minutes): The Board of Directors shall prepare Minutes to record the agenda, progress, and results of the meeting, and the Chairperson and two or more attending directors shall seal and sign and preserve the Minutes. The copy shall be distributed to the directors and auditors.
Article 29 (Regulations for operation of the Board of Directors): Matters necessary for the operation of the Board of Directors shall be stipulated by the Operation Regulations of the Board of Directors.
Chapter 4 Properties and Accounting
Article 30 (Classification of properties): ① The properties of the Museum shall be divided into basic properties and ordinary properties. The following properties indicated in each Subparagraph are considered basic properties, while other properties that do not belong to the following categories are regarded as ordinary properties. 1. Properties that the State contributed to the Museum as the expense of establishment of the Museum; 2. Properties that are determined as basic properties through the approval from the Board of Directors; 3. Properties acquired by donation or free of cost from individuals, corporations, or institutions. However, exceptions apply to the properties decided by the Board of Directors due to the difficulty of classifying basic properties according to the purpose of the donation.② Basic properties at the time of establishment of the Museum are listed in the annexed paper. ③ When the Museum intends to sell, transfer or provide its basic properties as collateral, it is required to obtain approval from the Minister of Land, Infrastructure and Transport following the approval from the Board of Directors.
Article 31 (Financial resources): ① The expenses required for businesses and operation of the Museum shall be supplied by the following Subparagraphs. 1. Contributions or donations from the State or a person (entity) other than the State; 2. Loan in accordance with Article 13; Income produced by the operation of the Museum; 4. Additional revenue ② The State can contribute expenditure required for businesses and operation of the Museum within the budget.
Article 32 (Accounting principles): The accounting of the Museum shall be processed according to the facts of its occurrence to clarify the business management performance and the state of increase or variation in properties.
Article 33 (Classification of accounting) ① The accounting of the Museum shall be based on general accounting in principle, and special accounting may be established, if necessary. ② Special accounting is warranted when a specific business is operated, when a specific fund is operated and when it is required to separate it from general income and expenditure by appropriating specific expenditures with other specific income.
Article 34 (Business year): The business year of the Museum shall apply the fiscal year of the government.
Article 35 (Request for budget): ① The Museum shall submit the budget request for contributions of the following year to the Minister of Land, Infrastructure and Transport, by April 30 every year. For the budget request for contributions pursuant to Clause 1, it is required to attach the following documents indicated in each Subparagraph. 1. A business plan for the next business year; 2. A statement of estimated financial state and estimated profit and loss statement, and the annexed detailed statements for the next business year; 3. Other materials that can explain the request for contributions; ③ When the Director intends to receive contributions, the Director shall submit application for payment of contributions to the Minister of Land, Infrastructure and Transport attaching a business plan for the corresponding year and a quarterly budget execution plan.
Article 36 (Business Plan.): ① The Director shall prepare a business plan and budget bill for each fiscal year and submit them to the Board of Directors. In addition, the Director shall submit them to the Minister of Land, Infrastructure and Transport by December 15 of each year following the approval from the Board of Directors, and obtain approval from the Minister before the fiscal year starts. ② The business plan pursuant to Clause 1 shall include business objectives, business subject, details of main businesses, beneficiary targets and business expenses. It is required to specify the details and reasons for the change and obtain approval from the Minister of Land, Infrastructure and Transport following the approval from the Board of Directors.
Article 37 (Provisional budget): ① If the budget proposal is not approved before the start of the fiscal year due to natural disasters or force majeure, the Museum shall formulate and operate a budget (hereinafter referred to as “provisional budget”) in accordance with the budget of the previous fiscal year. ② The provisional budget shall lose effect once the budget proposal for the fiscal year is approved, and the budget executed according to the provisional budget is deemed to have been executed according to the budget for the fiscal year.
Article 38 (Reserve fund): ① In order to provision for unpredictable expenditures beyond the budget or expenditures exceeding the budget, the Museum is allowed to reflect the amount within 5/100 of the total budget as a reserve fund in the budget. ② It is required to obtain approval from the Minister of Land, Infrastructure and Transport, in order to use the reserve fund pursuant to Clause 1.
Article 39 (Continuing expenses): For construction or manufacturing and R & D projects requiring several years to complete, the Museum shall determine, if necessary, the total amount of expenses and annual construction amount and reflect it in the budget as continuing expenses within the range of five years from the corresponding fiscal year.
Article 40 (Accounting audit): ① The Director shall prepare a balance sheet for each business year and submit it to the auditor. ② If necessary, the auditor may request the Director to submit the related materials. ③ It shall be the auditor’s obligation to conduct an audit on the settlement and report the result to the Board of Directors. ④ The auditor can request an accounting audit to a specialized institution to conduct an efficient accounting audit of the Museum, and the Museum shall be responsible for the cost incurred. ⑤ The auditor must audit affairs of the Museum with frequency and report the result to the Board of Directors.
Article 41 (Submission of balance sheet.): ① When the fiscal year ends, the Director shall prepare a balance sheet for the fiscal year without delay, and select a certified public accountant or an accounting firm to conduct an accounting audit. ② The Director shall submit the balance sheet audited pursuant to Clause 1 to the Board of Directors and obtain approval. In addition, the Director shall submit it to the Minister of Land, Infrastructure and Transport within two months posterior to the end of each fiscal year. ③ The balance sheet to submit pursuant to Clause 2 shall include the following matters from each Subparagraph. 1. Financial statements for the relevant year (including a certified accountant or an audit statement of an accounting firm pursuant to Article 23 of the Certified Public Accountant Act) and accompanying documents; 2. Financial statements such as balance sheets and profit and loss statement for the relevant year; 3. A business plan for the relevant fiscal year and the comparison table of its execution results; 4. A copy of the minutes of the Board of Directors meeting; 5. Other documents necessary to clarify the details of the settlement;
Article 42 (Loan) ① if it is needed for operation, the Museum may borrow funds after obtaining approval from the Minister of Land, Infrastructure and Transport. ② When the Museum intends to borrow funds pursuant to Clause 1, it is required to submit an application form indicating reason for loan, the amount of loan, the borrowing place, loan conditions, repayment method of loan, repayment period of the loan, a copy of Minutes of the Board of Directors that determined the fund borrowing and matters necessary for loan and repayment, to the Minister of Land, Infrastructure and Transport.
Article 43 (Handling of surplus): The Museum shall first allocate the surplus of each fiscal year for debt repayment, and carry the remaining surplus forward to the next fiscal year or use for business execution of the Museum.
Article 44 (Accounting regulations): Details of the Museum's properties and budget accounting shall be prescribed by the “Accounting Regulations.”
Article 45 (Profitable Businesses): ① In order to finance the expenses required to achieve the purpose of Article 1, the Museum shall carry out the following businesses from each Subparagraph, within the scope of not causing obstacle to activities related to Museum’s materials such as collection, management, conservation, investigation, research and exhibition as well as education and fostering personnel. In this case, each business (project) shall obtain approval from the Minister of Land, Infrastructure and Transport. 1. Museum-related information provision business; 2. Museum-related technology transfer and consultation; 3. Museum facility or equipment rental business; 4. Admission and participation in exhibition experience, education and performance; 5. Distribution of educational programs developed by museums; 6. Production and sales of museum-related souvenirs, publications, and booklets; 7. Lease of museum facilities 8. Advertisements using museum facilities; 9. Installation and operation of aviation-related experience facilities; 10. Other businesses deemed necessary by the Minister of Land, Infrastructure and Transport to raise revenues for the operation of the Museum; ② The Museum shall allocate revenue from profitable businesses to the management of the Museum. ③ Details necessary for the scope, procedure, operation and management of the profitable businesses of the Museum shall be determined as separate regulations after obtaining approval from the Board of Directors.
Article 46 (Reception and use of donations): ① In case there are donations with money or other assets to support collection, management, research and development of museum materials and foster outstanding professional personnel (hereinafter referred to as "donations”), the Museum shall receive them and issue a receipt to donors. If anonymous donations have been received or if the donor is unknown, a receipt may not be issued. ② When receiving donations pursuant to Clause 1, the Museum may sign an agreement if the donor wishes or deems it necessary for efficient management of the donation. ③ If the donor in accordance with Clause 1 designates the purpose of the donation, the Museum shall use it only for that designated purpose. However, if there is a special reason for the difficulty of using the donation for the purpose designated by the donor, it may be used for other purposes with the consent of the donor. ④ Among the donations, if there are land, research facilities, or research equipment pursuant to Clause 1, the Museum may use it jointly by signing an agreement. ⑤ Museum shall have a ledger displaying the status of reception and use the results of donations to allow donors to access the information. ⑥ The Museum must submit a statement of achievements or balance sheet regarding reception and use of donations for the previous year within 90 days following the end of the fiscal year, to the Minister of Land, Infrastructure and Transport, and is required to post detailed information on the Museum's website. ⑦ Details necessary for reception and use of donations shall be determined as separate regulations after the approval of the Board of Directors.
Chapter 5. Organization and Committee
Article 47 (Organization): Matters concerning the organization of the Museum shall be determined as separate regulations. Matters related to the organization deemed significant must receive approval from the Board of Directors.
Article 48 (Operation Advisory Committee): ① The Museum may establish the Operation Advisory Committee of the National Aviation Museum of Korea (hereinafter referred to as the “Operation Advisory Committee”) in order to facilitate consultation of the Director regarding businesses corresponding to Clause 1 of Article 4. ② The Operation Advisory Committee shall be composed of approximately 10 members and play the following roles. 1. Consultation on the direction of collection, management, conservation, investigation, research, and exhibition of Museum’s materials and the direction of Museum development; 2. Consultation on other matters deemed necessary by the Director for operation of the Museum and research on museum materials; ③ The members shall consist of personnel from academic, research, industrial and aviation-related organizations, and shall be appointed by the Director after deliberation at the Board of Directors meeting. ④ The term of office of the members shall be two years, and reappointment is allowed. ⑤ Allowances and necessary expenses can be paid to members within the budget. ⑥ Matters necessary for the composition and operation of the Operation Advisory Committee shall be determined by the Director in a separate manner.
Article 49 (Appointment of advisory attorney): ① The Director may appoint an advisory attorney to collect professional opinions regarding the following matters from each Subparagraph. 1. Matters regarding the interpretation and application of laws; 2. Matters about the enactment, amendment, interpretation, and application of the Articles of Association and general regulations; 3. Other matters concerning legal judgments related to litigation cases and assigned duties; ② The Director may appoint an advisory attorney as the litigation representative who can carry out litigation for the assigned case. ③ Expenses for the advisory attorney can be taken from the budget.
Article 50 (Appointment of litigation representative): If deemed necessary, the Director may appoint a legal representative to carry out litigation representation duties regarding the businesses of the Museum.
Chapter 6 Affiliated Institutions
Article 51 (Installation of affiliated institutions) ① The Director may establish affiliated institutions if they are necessary to promote efficient operation of the Museum pursuant to Clauses 2 & 3 of Article 3 of the Act. ② To carry out project promotion plans such as securing sites and buildings, and operation of workforce and budget for the installation and closure of affiliated institutions pursuant to Clause 1, it is required to obtain approval from the Minister of Land, Infrastructure and Transport following the approval from the Board of Directors. Chapter 7 Supplementary Provisions
Article 52 (Amendment of Articles of Association): When the Museum intends to modify the Articles of Association, the Board of Directors shall make a decision with the approval of more than two-thirds of the registered directors and obtain approval from the Minister of Land, Infrastructure and Transport.
Article 53 (Request for dispatch of public officials.): ① The Director of the Museum shall have rights to request dispatch of public officials to the head of the relevant administrative institution or educational institution by obtaining the approval of the Minister of Land, Infrastructure and Transport, when the assistance of the public officials is particularly needed to perform specific duties. ② When requesting the dispatch of personnel pursuant to Clause 1, the Director must submit a request for dispatch to the Minister of Land, Infrastructure and Transport, indicating the reason for the dispatch request, the dispatch period, the number of personnel dispatched, the field of expertise, and qualification requirements. ③ Employees dispatched to the Museum must comply with Articles of Association and all regulations of the Museum during the dispatch period and perform their assigned duties faithfully. ④ Employees dispatched to the Museum may receive a dispatch allowance within the scope of the budget of the Museum, in addition to the remuneration paid by their institution.
Article 54 (Enactment of regulations): ① The Director may separately determine matters necessary for the operation of the Museum. ② To enact or amend regulations concerning the following matters indicated in each Subparagraph, it is necessary to obtain approval from the Minister of Land, Infrastructure and Transport following the approval from the Board of Directors. 1. Matters regarding the change in the number of personnel; 2. Matters regarding the budget such as remuneration for executives and employees; 3. Other important matters for the operation of the Museum.
Article 55 (Attribution of intellectual property rights): ① Intellectual property rights such as copyrights and patents acquired during the service in the Museum or work performed by executives and employees shall belong to the Museum. ② For those who have contributed to the acquisition of intellectual property rights, the Director may offer separate compensation.
Article 56 (Management disclosure): The Museum shall take necessary measures concerning management disclosure and operation of the customer charter according to Articles 11 and 13 of the Act on the Management of Public Institutions.
Article 57 (Method of announcement): The Museum announcement shall be posted in major daily newspapers or on the Museum website. However, it is possible to announce minor matters by posting on the bulletin board at the location of the main office.
Article 58 (Regulations applicable mutatis mutandis): Matters not stipulated in the Articles of Association shall apply regulations of incorporated foundation based on the Act on the the Management of Public Institutions and Civil Law.
Supplementary Provisions
Article 1 (Enforcement date): ① The enforcement of the Articles of Association shall take effect from the date of registration of establishment with approval from the Minister of Land, Infrastructure and Transport. However, Articles 2, and Clauses 1 and 2 of the Supplementary Provisions shall be effective from the date of which the Minister of Land, Infrastructure and Transport approves.
Article 2 (Transitional measures): ① The acts related to the establishment of the Museum performed by the Establishment Committee of the National Aviation Museum of Korea (hereinafter referred to as the “Establishment Committee”) according to Article 2 of Supplementary Provisions before the enforcement of this Article shall be considered acts performed by the Museum, according to the Articles of Association. ② The Establishment Committee that deliberates and decides the present Articles of Association shall be regarded as the Board of Directors of the present Articles of Association. ③ Despite the stipulation of Article 6, the executives of the Museum who are first appointed after the enforcement of the Act shall be appointed by the Minister of Land, Infrastructure and Transport from among multiple candidates recommended by the Establishment Committee. ④ Despite Article 34, the business year that belongs to the year of establishment of the Museum shall be from the date of establishment to the end of the relevant fiscal year. ⑤ Despite Article 36, the business plan and budget for the year of establishment of the Museum shall be deemed to have been established when the Establishment Committee prepared and obtained approval from the Minister of Land, Infrastructure and Transport.
Article 3 (Special cases for appointment of employees): ① According to Clause 2 of Article 6 of Supplementary Provisions of Act on the National Aviation Museum of Korea, anyone who wishes to be appointed as the Museum employee among the public officials belonging to the Promotion Team of the National Aviation Museum of Korea who were engaged in the affairs regarding the establishment of the Museum is considered to have been appointed as a Museum employee. ② If it is judged necessary for smooth operation of affairs from the time of establishment of the Museum, the Establishment Committee may determine a separate procedure to select prospective employees of the Museum in advance among those working for the Promotion Team of the National Aviation Museum of Korea. In this case, the Establishment Committee shall be regarded as a Personnel Committee complying with the regulations of the present Articles of Association. ③ The Director shall assign a position or rank appropriate for the standards determined by the regulations of organization and personnel for public officials appointed as Museum employees according to Clause 1, and those who have been selected as prospective employees in advance according to Clause 2.
Article 4 (Succession of affairs, properties and obligations): ① The Museum shall comprehensively inherit all affairs, rights, and obligations that the Promotion Team of the National Aviation Museum of Korea was managing at the time of establishment of the Museum. ② For the establishment of the Museum, the founder named below shall contribute 1 million won (KRW 1,000,000) in cash, in compliance with the establishment fee specified in Article 2 of the Supplementary Provisions of the Act on the National Aviation Museum of Korea. ③ All members of the Establishment Committee shall prepare the present Articles of Association and seal and sign it, pursuant to Article 2 of the Supplementary Provisions of the Act on National Aviation Museum of Korea.
